Hi DG That neighborhood certainly has an edge and is less gentrified then other neighborhoods which does not necessarily mean it's unsafe. A Failure to Obey Sign traffic carries 2 points in New York. Because you didn't have an EZ pass with you, it sounds like you violated the sign when you entered the EZ lane. Further, there is no plea bargaining at the Traffic Violations Bureau so your only outcomes are either guilty or not guilty. I hope this helps. Good luck!! Matthew J. Forgetting to mount your EZ pass is not a valid defense. Fortunately, a VTL 1110a ticket is a relatively minor offense which only carries 2 points. You can try and fight it but these tickets are hard to beat in New York City. Matthew J. Kyle, The defect is missing info because the officer gave you a break. If you were to push the issue, in my opinion and experience, the prosecutor will amend the ticket back to the original charge. I wouldn't do it. In regard to your insurance question, your pending 1110a ticket should NOT have any bearing on your insurance rates. After a certain amount of time, a NYC traffic ticket will go into default judgment status meaning that the DMV found you guilty without your participation. The only option at this point is to submit an application to vacate the default. You'll need to set forth a reasonable excuse for your delay as well as a meritorious defense. Good luck! Matthew J. It is very hard to win ANY ticket in Staten Island (especially speeding tickets). If you have an otherwise clean driving record, then you could just pay this one. It only carries 3 points and, alone, will not affect your insurance rates.by askanewyorker - Ask a New Yorker :

Hi John, 1) what is the best way to present this evidence? You should be able to play it for the judge and also hand in a copy (perhaps on a flash drive). 2) Is this enough evidence to get the case dismissed? I cannot possibly answer this question. 3) What other evidence could be presented to negate this ticket? Photos and your testimony are other things that you can present. It sounds like you received a 2-point ticket for disobeying the EZ-Pass Only sign. The registration ticket carries 0-points but can adversely affect your insurance. Yes, you can simply show the Judge the pictures with the lack of a second one way sign on the right and point to the MUTCD regulations to show that the road is not "designated and signposted" as a one way. You should also get the police officer's notes and compare them to his testimony and the information in the ticket. Look for inconsistencies. AndyB, There is not inert requirement for this violation. Therefore, despite it being an honest mistake, this is not a defense to this ticket. Plus, the Staten Island Traffic Violations Bureau is the most difficult court in New York State in which to beat a ticket so I doubt that you will win if you fight it. Hi Martin Fire Island is one of my favorite Day trips. It's quite easy to get to using the Long Island rail. Depending which town you choose to visit it's approximately 2 to 3 hour travel time. It's a sliver of an island that's parallel to Long Island no cars allowed. There is quite a few towns and villages on the island about 10 or so each with their own flavor. The officer is not required to explain to you why he or she gave you the ticket (although they normally do). If there are no signs and you were charged with disobeying a sign, then take a bunch of photos to show the judge.
