I got a cell phone ticket in tioga ny the cop put the wrong mailing address to return it back to the court. The court had a p.o. box he put the physical address .. is this ticket defective.?

Jill,

In NYC, there are no deals or plea bargains. If you fight this disobey traffic control device ticket, you will either win or lose, nothing in between.

Brad,

No, this error does not render the ticket fatally defective.

I still recommend that you fight it. If you do, you likely can get this reduced to a less serious charge at the Tioga traffic court.

My son was driving my car alone and he has a permit only, he was pulled over, aswell as 3 other cars and given a ticket for driving on the shoulder lane of the highway on the bruckner. The cop gave him the ticket and told him to be on his way. I tried to pay the ticket but the ticket was sent back and said the payment was not accepted and that he has to appear at the traffic bureau. He took his license exam the next day and passed. He recieved his liscense in the mail. What would happen after he reports to the traffic bureau?

Manny,

Because your son did not have a license, a "personal appearance" is required. This is because his ticket is more serious than a normal ticket (i.e., one which could result in a suspension or delay in the issuance of his regular license).

I, therefore, suggest that you consult with an experienced NY traffic ticket lawyer given the situation.

Hello Sir/ Ma'am,

I received my first and only speeding ticket going 65 in a 40. I was coming off a ramp going onto the expressway and accelerated to flow with traffic I was caught with a laser going 65 in a 40. Should I plead guilty or not guilty to go before a judge for a lesser fine and points?

Hi,

So I was given a ticket last night for failure to stop at a stop sign (1172-A). I was coming off of an exit ramp and merging onto an avenue and there were no cars at all on the road so I just did a rolling stop, and an officer pulled me over. Problem is, I'm 16 and still have my junior license, Class DJ. So does this mean I will have my license suspended for 60 days? or just points on license?

Also, should I just plead guilty and pay it and hope for the best or should I plead not guilty and fight it down to a 1110? I heard that is a lesser offense, only 2 points vs. 3 for the other one. Not sure what to do! I just want to keep my license, I need it to go to and from school an basketball practice. Thanks in advance.

Hi - I just got a Cell Phone ticket in NY, and I am an NJ resident with an NJ license. Can you please tell me if this will cause any points on my NJ license, and if this will effect my insurance costs at all ? I have had a clean driving record for at least 3 years, and I dont believe that I have any current points on my license.

You should plead not guilty to this speeding ticket. This is the only way to try and get a more favorable outcome.

Ben Kalish,

You should plead not guilty and fight this ticket. This is the only way to get a more favorable result. Further, because you only had a junior license, a conviction to this ticket can impact your ability to get a regular license. This provides another good reason to fight it. Given the seriousness of your situation, you should consider retaining an experienced NY traffic ticket lawyer.

Good news! Because NJ does not assign points for a cell phone ticket, a conviction in NY to this charge will NOT result in any NJ points. NY, however, will give you 2 point son your NY record.

Hi Matt, my brother received a ticket that says Unlicensed GT 60Days. He didn't have his license on him when he was pulled over at a check point, and it was an out of state expired license anyway. He was given advice to plead not guilty and get his NY license before the hearing date, which he did. However since he didn't have a valid license at the time of the ticket, won't he just be found guilty and then not only responsible for the fines but also court costs?

Wondering what you would recommend, and also if you can ballpark what the fines and penalties would be if he just plead guilty?
