I got pulled over in Southampton for speeding. I don't know how this could be because we both were traveling in opposite directions on the same street. How could he accurately gauge my speed.

Jenny H,

The officer could have visually estimated your speed and/or used a radar/laser device. Either one of these methods are admissible in court.

You should definitely plead not guilty and fight this speeding ticket. If you do, you likely can save points and possibly money.

hello
few weeks ago i got ticket for turning right from lane i shouldnt...
a police officer puled me over and gave me a ticket.
so as it says on the ticket i sent a money order to the dmv.
yesterday i got letter back which says:
"this specific plea requires a personal appearence by you at any traffic violations bureau..."

of course if i wont show up there will be consequences which are listed below...
my question is why do they want me to show up?!?!

Failure to yield to pedestrian

Hi,

Two days ago I was stopped in Brooklyn and given a ticket for "Failure to yield to pedestrian". The officer stopped me on E12 st, but ticket says it was a corner of Coney Island Ave and Kings Hwy. I do not remember ever not yielding to pedestrian (this situation is included) and had not moving violations until them. Neither did I see the officer until I turned into E 12 st (probably he was several cars behind)
Questions:
1. How much is the fine (I was unable to find this information anywhere)?
2. Should I fight it or plead guilty?
3. I have not found that ticket in the system when I tried to go to www.dmv.ny.gov/pnp.htm, so I could not plea on line. Should I plead by mail or wait for it to appear in the system.
4. I am from NJ. Do the points from NY worth fighting for?
5. Should I request the officer's records and how to do it?

Hi,

I was recently in an accident on I-87 in upstate ny, in the area of catskill. My car went off the left lane, i couldn't control it at that point and hit the left side barrier. It think it was at that point my left front and back tires blew out and when i tried to get it back on lane, the back wheels of the car spun out to the front and the car spun across both lanes, and then hit the right barrier. Someone called the police for me. And 30min later, when he was writing my report, he gave me a "Moved from lane unsafely" ticket. I dont know why i was given this ticket, as i dont think it was my fault my tires blew out because of the impact and the car spun out over two lanes. Also, there is no supporting deposition on the report.

The Not Guilty Plea says to mail in 48 hours? Is that serious? I just read it. If i Do decide to plea not guilty. How would this work out? Because i have no way of transportation there. As my car is completely damaged. Do they make out-of-state drivers actually come to the specified court in person?

Please let me know what i can do. As i had gotten a 6 point speeding ticket in upstate in august 2011. And i do not want anymore points or assessment fees. Also i am a NJ driver.

Please help me. As this incident happened exactly a week and 4days from now. And i need to mail in this ticket plea.

Adam,

This is relatively serious. A "personal appearance" is only required when you could be suspended or revoked if you are convicted to that particular ticket. The personal appearance could be required for a number of reasons including too many points, probationary license, etc.

I highly recommend that you retain a NY traffic lawyer because this will hopefully help you avoid losing your license.

Answers follow your 5 questions below:

1. How much is the fine (I was unable to find this information anywhere)? The fine for this ticket will be roughly $150 to $200.

2. Should I fight it or plead guilty? You have to decide but we usually recommend to our clients to fight their traffic tickets. This is the only way to obtain a more favorable result.

3. I have not found that ticket in the system when I tried to go to www.dmv.ny.gov/pnp.htm, so I could not plea on line. Should I plead by mail or
wait for it to appear in the system. You should wait for it to appear on the DMV website. Check regularly so you don't get a suspension.

4. I am from NJ. Do the points from NY worth fighting for? If are convicted, this ticket will transfer as 2 points onto your NJ license.

5. Should I request the officer's records and how to do it? No, in NYC, there is no pre-hearing discovery for traffic tickets.

Riaz,

You should mail the ticket to the court with some type of delivery confirmation and enter a not guilty plea right away. Because you are late, you should also call the court and let it know that your not guilty plea is en route.

Given that you have 6 points already, you should seriously consider hiring an experienced NY traffic lawyer to help you. If you do, you will NOT have to appear in court.

Because you already pled guilty, you have very few options. There is a procedure to un-do your guilty plea but it may not be granted and takes time to prepare. If you are interested in learning more about this procedure, feel free to call us.

I received a ticket for disobeying. A controlled traffic device I turned where only busses can turn in NYC I would like to know if they ever plead. Out without PTs I live in nj and really want to avoid. PTs I don't. Care about the fine
