Evan, Weird. A stop sign ticket carries 3 points (an adult seat belt has 0 points). Therefore, I recommend that you plead not guilty. If you do and this NY traffic ticket was issued outside of New York City and Rochester, then you likely can negotiate this down to a less serious charge. Good luck. ANJ, You should plea not guilty by mail. You will receive back a court notice date where you or your New York traffic lawyer will need to appear. At that time, this case can likely be reduced to a less serious (even 0-point) charge. Good luck! Ahmed, The only way to avoid this 2-point traffic ticket for making an improper turn is to plead not guilty and hopefully beat the case at your hearing. In NYC, they do not plea bargain so it is "all or nothing". Good luck! Michelle, It sounds like your case was dismissed. If you had a valid license on the date of the offense, then the DMV likely looked that up and dismissed the case on its own. If you were not licensed on that day, then you should keep checking the system as your traffic ticket could "hit" belatedly. Edrouine, You should gather any evidence that you can to show your alibi to these two traffic tickets. I would also get a copy of the registration for the car that is alleged to be involved with these two tickets and determine whose car it is. Good luck! Blay, Sometimes it can up to 30 days for a NYC ticket to "hit" the system. While the ticket states that you only have 15 days to answer, you actually have much more time. Evan, You can make that argue but don't expect to win (especially at the Staten Island Traffic Violations Bureau). This court is the toughest court for motorists in all of New York State and they do NOT plea bargain. Fortunately, if you get a disobey a traffic control device ticket, you only get 2 points. This ticket carries 2 points in NY and will transfer as 2 demerit points in Ontario. On your court date, you may be able to negotiate this down to a 0-point ticket that doesn't transfer to Ontario. However, because the police officer already gave you a "roadside" break, you may not be offer a reduction. Give it a shot, however. Good luck! G, This unsafe backing ticket alone will likely NOT affect your insurance rates. In New York, you may receive one "small" ticket without your rates going up. I assume MA is the same. Isaiha, Yes, you can plead not guilty. The court will schedule you for a date where you can contest the ticket. Edna, You most certainly can ask for a supporting deposition. The only way to avoid a fine is to beat this ticket at trial. You'll need to prove (documentation really helps here) that you were engaged in a true emergency call. Otherwise, you can try and see if you can negotiate this down to a less serious charge. Gordy, You likely won't get points for this because you were not issued a summons by a police officer at the scene. You could be fined or even suspended by the EZ Pass people however. Answers follow each of your questions. If I plead not guilty what do I say how do I fight it? You should politely ask if you can work out a plea bargain. It seems from my research that if I plead guilty I will be given 150$ fine and 2 points. Will this show up on my record in PA/NJ or just NY? Megan, You should plead not guilty. If you do, you or your traffic lawyer can likely negotiate this down to a 0-point ticket. You can likely handle yourself but, if you're uncomfortable, you can get a NY traffic lawyer to handle it for you. Yes, you need to repair the broken windshield within 24 hours of the issuance of the traffic ticket. You present the proof of repair to the prosecutor on your court date. Keep in mind that in the Nassau County Traffic Court, they charge $15 for a dismissal based upon a repair (the only court in NYS that does this). Rich, How you handle your conference depends on a few variables including your driving record and the court in which your case is to be heard. Generally, dress well (business causal is okay) and be polite. If your record is otherwise clean, make sure you point this out. Good luck fighting this traffic ticket!
