You generally are not allowed to submit new evidence or witnesses on appeal. You are required to present ALL your evidence at your hearing. Therefore, I do not think adding additional information will help you on the appeal.
I believe that you likely can negotiate this NY speeding ticket down to a less serious charge (despite your admission). Therefore, definitely plead not guilty.

The fine for this ticket will be roughly $200.
In New York City, there is no plea bargaining or deals. It is "all or nothing". The only way to obtain a more favorable outcome than the 3-point ticket is to fight it and beat it at trial. If you would like a free consultation with a NY traffic ticket lawyer, feel free to call us.

Mr. Weiss,

Firstly, I applaud you public service in this forum.

I'm sure this question has been answered somewhere along the line here but my searches did not result in a specific return.

From reading some of the posts, I've been able to gather the "all or nothing" stance of traffic citations issued in NYC.
So is my understanding correct that there is no "pleading down" to a lesser vioaltion?
Specifically, a cell phone wile driving ticket issued in Queens.
Fine amounts aside, can one get a reduction in the vioaltion, say to a parking violation, and pay the prescribed fine without incurring points on one's license?
Or are the only possible outcomes, "guilty as cited" or "dismissed"

Thank you in advance,

Me and a friend are going to New York on the 30th of June and are for staying for 8 nights in Lafayette street in Soho. we are really looking forward to this, I was just wanting to know what you would recommend for us to see and if there was any special events on at the time we are over? I know we are there for Independence day. we are both big movie fans and love watching American comedy shows like everybody loves Raymond, Kings of queens, Friends just to name a few and love the humor of Family guy also lol. We are both also big Soccer fans so we would love it if there was any big sporting events or matches that we could go and see like Baseball and American Football as we would love to get to experience this. but there are maybe no matches on when we are over. Hopefully you can give me some info on this, as I am really looking forward to going over and want to make the most of my time there.
Thanks
Because you already a break by the officer, you are taking a risk if you fight this ticket. The prosecutor could amend the ticket back to the original, more serious NY speeding ticket charge. Even if the ticket isn't amended, you are unlikely to be give a second break.
The police officer actually gave you a break called a "roadside plea". He reduced your 4-point NY speeding ticket to a 2-point NY traffic ticket. The fine for a disobey traffic control device ticket is roughly $150.

If you plead guilty, the NY traffic ticket conviction will be reported to MA but it likely won't affect your auto insurance rates (especially if you have an otherwise clean record).
Your odds are very high for an offer to reduce the charge. Your NY speeding ticket carries 4 points so an offer to 2 points is most likely (although you may even be able to get a 0 point offer given your clean record).
It sounds like this traffic ticket was issued/served ... just not to you. You should plead not guilty and fight the ticket. Try and obtain a copy of the ticket to find out what information regarding "you" and "your" car is listed.
