Yes, you need to repair the broken windshield within 24 hours of the issuance of the traffic ticket. You present the proof of repair to the prosecutor on your court date. Keep in mind that in the Nassau County Traffic Court, they charge $15 for a dismissal based upon a repair (the only court in NYS that does this).

Hi Matthew,


I'm seeking your advice on a moving violation I got two days ago. I "rolled through" a stop sign in a residential neighborhood and was pulled over and given a summons under the section 1172a (3 points) and don't know what the best next step is. I want to negotiate and get the points removed and a smaller fine if possible. I'm unsure whether to plead guilty or not guilty and if I need to get a lawyer for this? I did slow down and stop for about 1 second (so I didn't completely roll through).

Generally, you only have 24 hours to repair an equipment violation.

Megan,

You should plead not guilty. If you do, you or your traffic lawyer can likely negotiate this down to a 0-point ticket. You can likely handle yourself but, if you're uncomfortable, you can get a NY traffic lawyer to handle it for you.

I got two summons today. I got pulled over for driving with headphones in. Unfortunately I did have both headphones in. I also got another ticket for driving with a learner's permit. I'm 18 and this is my first offense. Would it benefit me if I scheduled my road test before my court date? What are the consequences? Also, how many points will I get?

NY Upstate Ticket - Disobey Traffic Device - Live in PA

I was pulled over for speeding on the NY thurway as I passed through NY to VT. I was given a "disobey traffic device." I can not return to court to fight this as it is over 5 hrs from my residence.

If I plead not guilty what do I say how do I fight it?

It seems from my research that if I plead guilty I will be given 150$ fine and 2 points. Will this show up on my record in PA/NJ or just NY?

How would my insurance company find out?

You are supposed to fix any vehicle equipment violation within 24 hours of the issuance of the traffic ticket.

You could have been charged under a few different sections of law so I would have to see the headphones ticket to let you know whether it carries points. Feel free to fax or email it to us.

You should plead not guilty. This is the only way to possibly obtain a more favorable outcome.

Answers follow each of your questions.

If I plead not guilty what do I say how do I fight it? You should politely ask if you can work out a plea bargain.

It seems from my research that if I plead guilty I will be given 150$ fine and 2 points. Will this show up on my record in PA/NJ or just NY? In regard to points, it will show up in NY but not your PA license. It will be reported to PA however.

How would my insurance company find out? If your insurance company runs your record, then it can find out about any convictions on your record that are reported to PA.

I didn't know u can go thru the booth and they will bill you the $5.00. I panic stopped backed up and when thru the next booth. Will I get a tickets and points on my license.

You likely won't get points for this because you were not issued a summons by a police officer at the scene. You could be fined or even suspended by the EZ Pass people however.

Hello,

I received a a cell-phonewhile driving ticket. When pulled over I informed the officer I was on an emergency call with my son (whom is 6 yrs old) school regarding an incident that involved him at school. The officer;s responded if it wasn't 911 I was calling it didn't matter. I wasn't given a supporting deposition with my ticket. I have proof (screenshot of the call and to whom it was with), should I plead not guilty and request a supporting deposition? Reallistically what are my chances of having this resolved without being fined? Will I have to pay a fine to appear in court as well when a date is set?
