Brigabran,
Simple. Just write a letter entering your "not guilty" plea to the speeding ticket and send it in with the ticket via certified mail, RRR.
Good luck!

Brigabran,
You can simply write a letter indicating your not guilty plea to the court. You should include a copy of the letter. Make copies of everything for your records. This will solve the problem.
Good luck!

Another question, I was pulled over September 7, 2014 and my motorcycle was impounded due to having an expired inspection sticker. However, that was not the case. I have a ledger from the company I got my inspection done; in addition, my inspection sticker is/was current on the date of my bike being impounded. What is the process of getting my money back from the impound fee which I had to pay to retrieve my motorcycle. Furthermore, what other steps can I take based on such unlawful act and harassment?

Nate,
You case is not "beatable" simply because your court date is more than a year from the date of offense. I know of no procedure to get your "impound" fee back. If you are truly correct, then you can sue NYC in Small Claims Court.
Good luck!

Question, I received a ticket on 3/7/2012 and my court date for this ticket is 12/7/2014. Since this ticket is a more then a year old, is it beatable. Coming our of a 7 eleven and made a left turn onto New Dorp Lane in Staten Island. I do not believe that there was a sign there in the past. Must have been new. Cop pulled me over and gave me 1110a ticket. My question is can I fight it claiming it was a new sign and I did have knowledge not time to adjust to new traffic patterns?
Re: Ask a New York Traffic Lawyer October 22, 2014 05:03PM |
Hi Matthew - I was driving down 125th street in Manhattan, I pull a U turn. I do this from the leftmost lane into the leftmost lane, ensuring that it is safe to do so and complete the Uturn in one turn. There are no U-turn prohibited signs. As soon as I complete the U-turn a police car pulls out and stops me. When the cop walks up, he asks me if I know why I was stopped and I said I did not. He said that I had pulled an illegal U-Turn and that I crossed a double yellow line (there was a double yellow line). He issues me a ticket - VTL in violation of 1160e (UTurn Improper). Looking up the code though, it says nothing about not crossing double yellow lines. Should I plead not guilty and what is the likely penalty of pleading guilty - I have no prior violations?
Thank you.
Thank you.

Evan,
You can make that argue but don't expect to win (especially at the Staten Island Traffic Violations Bureau). This court is the toughest court for motorists in all of New York State and they do NOT plea bargain. Fortunately, if you get a disobey a traffic control device ticket, you only get 2 points.

I was just stopped for running a stop sign and the officer said he gave me a break by giving me disobey traffic control device 1110a. He said I should go to court and try and have it reduced. I have no points on my license my record is clean. How do I try and have this reduced ? When I go to court do I plead guilty or not guilty? I heard if you plead not guilty you can possibly face the maximum charges for trying to get it reduced even further? I'm so confused. It was my first time on that road and i didn't see it.
